(English) HRCSL issues a report on the 2023 floods in Matara District

The Human Rights Commission of Sri Lanka issued an important report on the 2023 floods in Matara District. The report finds that the disaster was not caused only by heavy rainfall, but was made much worse by serious failures of public authorities and poor management of water infrastructure.

After receiving complaints and carrying out monitoring, the Commission found that several state institutions, especially the Department of Irrigation and the National Water Supply and Drainage Board, contributed to the flooding. According to the report, major causes included the blockage of the historic Dutch Canal, the failure to properly maintain traditional irrigation and drainage systems, and the construction of a salinity barrier across the Nilwala River at Weragampita in Matara. The Commission also noted that this salinity barrier had been installed without properly consulting and obtaining the free, prior and informed consent of the affected communities.

As a result of these actions, flood water remained in the area for a long period, causing severe damage to homes, lands and livelihoods. Many people were unable to continue their farming, fishing and other income-generating activities. The stagnant water also created serious health and sanitation problems for the affected communities.

The HRCSL has concluded that these failures amounted to violations of the fundamental rights of the people of Matara, including their freedom to engage in their lawful occupation and earn a living.

The Commission has called on the relevant authorities to provide immediate and scientific compensation to the affected people and to urgently repair and improve the damaged infrastructure. It has also recommended the establishment of a “Disaster Reparation Trust Fund” and the adoption of a national infrastructure policy that is free from political influence, so that similar harm can be prevented in the future and the rights of the people can be better protected.
